1. About these terms
These terms cover the games, applications and websites provided under the PocketSpark Studios brand that link to this document. We refer to these as the Services and to PocketSpark Studios as PocketSpark, we or us.
Please review these terms before using the Services. If a Service asks you to accept them, you may choose not to accept and not to use that Service. Additional terms for a particular feature will be presented before you choose to use it.
2. Who may use our games
Our games are not directed at children. You must be at least 16 in the European Union and United Kingdom, at least 13 in the United States, and meet the applicable local minimum age for consent to the relevant data processing elsewhere. These are the access limits described in our Privacy Policy, not a statement that every country has the same legal age rules.
You must also have the legal capacity to enter into these terms. If you meet the access age but local law requires permission from a parent or guardian, obtain that permission before using the game. Parental permission does not remove the access limits above.
3. Permission to use the Services
You may install and use our games for your personal, noncommercial entertainment, subject to these terms and the rules of the store from which you obtain them. This permission does not transfer ownership of the game or its content to you.
You are responsible for having a compatible device and any connection needed for the features you use. Your mobile operator or internet provider may charge for data. Features and availability may differ between games, versions, devices and regions.
4. Acceptable use
Do not use the Services to break the law, infringe another person's rights, harass others or send harmful content. Do not interfere with their security or operation, introduce malicious software, access systems without permission, or manipulate advertisements or rewards through fraud or automated abuse.
You may not sell or redistribute our games or assets without permission, or remove ownership notices. These restrictions do not prevent activities that applicable law permits, including legally protected research, interoperability, accessibility or other exceptions.
5. Game progress and local storage
Some games save progress and preferences on your device. PocketSpark does not maintain its own server database of that local progress. Where no separate synchronization feature is provided, progress may not transfer to another device.
Clearing application data, uninstalling a game or losing access to a device may result in lost progress. Device backups depend on the operating system and its settings. We cannot promise to restore data we do not hold. This does not remove any remedy you have if a loss results from our failure to meet our obligations.
6. Advertising and third-party services
Our games may display advertisements, including optional ads connected to in-game rewards. Where a reward is offered, the game will describe it and the steps needed to receive it. Ad availability can depend on the device, region, connectivity and advertising providers.
We may use Appodeal and enabled advertising partners in games that include that integration. Our Privacy Policy explains the relevant data practices and choices. Agreeing to these terms is not consent to personalized advertising or other processing that requires a separate choice.
Ads and links may lead to services operated by other businesses. Review their terms before using those services or making a purchase. A third-party link does not mean PocketSpark operates that service. This distinction does not exclude our responsibilities for our own Services.
7. Paid features, if offered
These terms do not mean that every game offers purchases or subscriptions. If we offer a paid feature, its price, contents and any renewal conditions will be shown before you authorize payment. A subscription requires a separate purchase decision; accepting these terms does not start one.
Payments made through an app store are also subject to that store's applicable purchase procedures. Cancellation and refund rights depend on the transaction and applicable law. We do not impose a blanket no-refund rule or remove your statutory rights. Contact us if you need help with a PocketSpark purchase.
8. Intellectual property and communications
The games, artwork, text, audio, software and branding supplied through the Services belong to PocketSpark or their respective rights holders. Any third-party or open-source license applicable to a component continues to govern that component.
You keep your rights in messages and attachments you send to support. Send only material you are entitled to share and avoid sending passwords or unnecessary personal information. We use support communications to handle the request as explained in our Privacy Policy. Sending a message does not grant us ownership of your work or permission to publish it.
9. Privacy
Our Privacy Policy explains how personal information is handled and how to contact us about your rights. It is separate from permission to process data for activities that require consent. Your privacy choices remain available independently of these terms.
10. Updates and availability
We may update the Services to fix problems, improve security, support compatible systems or change features. We do not guarantee uninterrupted access or compatibility with every device. Information given about a particular game and any obligations required by law still apply.
If we plan a change or discontinuation that materially affects your use, we will provide appropriate notice and explain the available options. Urgent security or legal issues may require action sooner. Changes do not remove rights you have in relation to an earlier purchase.
11. Stopping use and restrictions
You may stop using a game at any time. If you have separately purchased a subscription, uninstalling the game does not by itself cancel it; use the cancellation procedure identified when you purchased it.
Where a Service has access controls, we may restrict access to address a serious breach of these terms, fraud, a security risk or a legal requirement. The action must be proportionate to the reason. Where reasonably possible, we will explain it and give you an opportunity to resolve the issue or contact us to challenge a mistake. Urgent protective action may come first.
12. Your rights and resolving problems
If something goes wrong, contact us with the game name, the problem and any relevant purchase information. Do not send full payment-card details. We will review the issue and explain the next steps.
Nothing in these terms takes away rights or remedies you have under applicable consumer law. We remain responsible where the law makes us responsible, including for defective content, failure to provide a promised service, fraud or harm that cannot lawfully be excluded.
Applicable law determines the law and courts for a dispute. These terms do not require mandatory arbitration, waive class or collective claims, or prevent you from contacting a regulator or a court available to you. Contacting support is not a condition for exercising those rights.
13. Changes to these terms
We may revise these terms to reflect changes to the Services, legal requirements or how the Services are provided. We will identify the revised version by its date and give appropriate notice of material changes before they apply. Where agreement is required, we will request it separately. Changes will not retrospectively remove rights you have already acquired.
If one provision cannot be enforced, the remaining provisions continue only to the extent permitted by law. This does not allow an invalid term to be replaced with one that reduces your legal protections.
